# 1 Update the Acting President Bylaw

Purpose: to clarify what happens if the President role falls vacant or if the President takes a leave 

Current:

Bylaw 6: Duties of the Officers

4) The Vice-Presidents shall:

  1. If the office of the President falls vacant, be Acting President until a new President is elected.  This vacancy shall be filled until an election can be held on a rotational basis as follows:

January to April                             Component 1 Vice-President

May to August                               Component 2 Vice-President

September to December             Component 3 Vice-President

Bylaw 6: Duties of the Officers

10. President Position Vacancies and Leaves.

1) If the President takes a leave, an Acting President from the Executive Board shall take on the duties of the President for the duration of the leave. If the office of the President falls vacant, an Acting President from the Executive Board shall take on the duties of the President until an election can be held.

2) The Acting President will be a paid position. They will either take a paid Union President leave as per the collective agreement, or a more limited position will be taken on.

3) The Acting President shall be determined as follows:

a) As soon as it is known that the President will be taking a leave or that the President’s position is vacant or will soon fall vacant, the Executive Board will be informed that one of them will need to take on the Acting President role and be advised as to the rules laid out in this bylaw. Within one week of this, a Special Emergency Executive Board meeting to determine the Acting president shall then be held. At the meeting:

i) each of the three Component Vice-Presidents shall indicate if they are able and willing to take on the Acting President role. If only one Component Vice-President is willing to take on the role, they shall be acclaimed the Acting President. If two or three of the Component Vice-Presidents wish to take on the role, it will go to an immediate election for the Executive Board to vote on by secret ballot.

ii) If no Vice-President is willing to take on the Acting President role, it shall then be offered to the Equity Vice-President. If they are willing to take on the role, they shall be acclaimed the Acting President.

iii) If the Equity Vice-President is unwilling to take on the role, it shall be offered to the Recording Officer and the Communications Representative. If only one is willing to take on the role, they shall be acclaimed the Acting President. If both wish to take on the role, it will go to an immediate election for the Executive Board to vote on by secret ballot.

iv) If neither the Recording Officer nor the Communications Representative are willing to take on the Acting President role, it shall then be offered to the Component Members at Large. If only one Component Member at Large is willing to take on the role, they shall be acclaimed the Acting President. If two or three of the Component Members at Large wish to take on the role, it will go to an immediate election for the Executive Board to vote on by secret ballot.

v) If the President has not yet stepped down and is able to attend the meeting, they shall have a vote.

                                                                                                                                               

#2  Update Stewards’ elections and term

Purpose: To add flexibility around elections by recognizing different departments’ needs and to allow stewards to stay in their role for two years

Component 1: Stewards shall be elected at the Fall departmental orientations and as vacancies arise.

Component 2 (Continuing Studies): Stewards shall be elected as vacancies arise.

Component 2 (Residence Life): Stewards shall be elected in September and as vacancies arise.

Component 3: Stewards shall be elected as vacancies arise.

2.Election of Union Stewards

  1. a) Steward terms shall run for two years. Stewards will notify the component Vice-President if they do not wish to continue for a second year.
  2. b) Component 1: Stewards shall be elected in April or at after the Fall departmental orientations, as determined by the department membership. and Elections shall also be held as vacancies arise.

Component 2 (Continuing Studies): Stewards shall be elected as vacancies arise.

Component 2 (Residence Life): Stewards shall be elected in September during the summer orientation and as vacancies arise.

Component 3: Stewards shall be elected as vacancies arise.

#3. Remove Trustees’ ombudsperson role and insert reference to the CUPE Trial Procedure into the bylaws

Purpose: Direct members to the CUPE Trial Procedure for complaints against union officers and other members

h.Act as ombudsperson on behalf of the members with respect to complaints against the Board or any members thereof.
i. Provide a report of investigations to any complaining member within two weeks of the complaint.

Bylaw 16: Complaints and Trials

All charges by members against other members or Officers must be made in writing and dealt with in accordance with the Trial Procedure provisions of the CUPE National Constitution.

                                                                                                                                                           

#4 Add Diversity Stewards          

Purpose: to provide another option for members who need the Union’s help and to open up another avenue for equity seeking members to participate in the union.

  1. Diversity Stewards
  1. In addition to the departmental and faculty Union Stewards, there shall be local-wide Diversity Stewards representing the 5 equity seeking groups: Indigenous People, 2SLGBTQI+ People, Persons with Disabilities, Racialized Workers, and Women.
  1. Diversity Stewards shall
  2. a) Act as a liaison between members of their equity-seeking group and the Executive Board and/or

    Union Office.

  1. b) Take part in steward training and assist in grievance proceedings when required.
  2. c) Attend regular membership meetings and Diversity Steward meetings.
  3. Diversity Stewards shall be elected in April and as vacancies arise. Any member who self-identifies as being from an equity-seeking group can run to be the steward for that group.

#5 Union political donations 

Purpose: to support 4163 and other CUPE BC University Sector local members who wish to run for CUPE BC or CUPE National Executive Board positions.

4) Donations

  1. Donations for Provincial and National union elections

The Executive may approve a donation of up to $150.00 for campaign expenses to a 4163 member or a member from one of the CUPE BC University Sector locals running for a CUPE BC or CUPE National Executive Board position.
